This Privacy Policy and Terms of Use ("Policy") describes how Hartman Kelly Team, with Amy Stockberger Real Estate ("we," "us," or "our") collects, uses, discloses, and protects information about you when you visit www.hartmankelly.com (the "Site"), use our real estate services, or interact with us in connection with buying, selling, or renting property. Information you provide to us: name, email address, phone number, and mailing address; property preferences such as location, price range, property type, and number of bedrooms or bathrooms; messages, inquiries, and feedback you send through our contact forms or by email; information provided during open house sign-ins or consultations; and account login credentials if you create an account.

Information we collect automatically: IP address and general geographic location, browser type and device information, pages visited and time spent on the Site, listings you view or save, search queries, and information collected through cookies and similar technologies (see Section 7).

Information from third parties: Multiple Listing Services (MLS) when coordinating transactions, social media platforms if you connect an account, and publicly available records such as property and tax records.

2. How We Use Your Information

We use your information to respond to your inquiries and connect you with listings or agents; schedule property tours, open houses, and consultations; send transactional messages such as appointment reminders and service updates; send property alerts, market updates, and marketing communications where you have opted in; facilitate real estate transactions; operate and improve our Site and services; comply with legal obligations; and detect and prevent fraud.

3. How We Share Your Information

We may share your information with licensed real estate professionals involved in your transaction; service providers who assist us in operating our business, such as CRM, email, hosting, and analytics providers; MLS and industry databases as required by professional rules and regulations; and as required by law or in connection with a merger, acquisition, or sale of our business.

Other than as set forth herein, data will not be shared with third parties for marketing or promotional purposes. We will never disclose any personal information such as phone numbers and SMS consent with any third parties for marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

4. SMS Text Messaging Terms of Use

(i) Use of SMS Text Messaging. We use SMS text messaging to send appointment and showing confirmations, reminders, listing alerts based on your preferences, transaction updates, and promotional messages such as new listings, open houses, and local market updates.

(ii) Unsubscribing from SMS Text Messaging. You can cancel the SMS service at any time. Just text STOP. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

(iii) Assistance. If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at bruce.hartman@icloud.com.

(iv) Carrier Liability. Carriers are not liable for delayed or undelivered messages.

(v) Frequency and Data Rates. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

(vi) Consent. SMS opt-in is optional and is not a condition of any purchase or service. You provide consent through our opt-in form or by otherwise agreeing to receive text messages from us.

5. Your Rights and Choices

You may access or correct the personal information we hold about you, opt out of marketing emails using the unsubscribe link in any marketing email, opt out of SMS by replying STOP, and request deletion of your personal information subject to legal retention requirements. 6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, or as required by law. Real estate transaction records may be retained for several years under applicable state licensing laws. When information is no longer needed, we securely delete or anonymize it.

Our Site uses essential, analytics, preference, and marketing cookies to operate the Site and improve your experience. You can control cookies through your browser settings. Disabling certain cookies may affect Site functionality.
